The High Court of the Federal Capital Territory has struck out the forgery charge brought against Prof. Mike Ozekhome, SAN, in connection with a London property dispute involving the late former FCT Minister, General Jeremiah Useni.

Justice Peter Kekemeke gave the order following the withdrawal of the charge by the federal government.

The prosecution, represented by Rotimi Oyedepo, SAN, stated that the decision was made after a review of the case file and in accordance with Section 108 of the Administration of Criminal Justice Act. The defence, led by Paul Erokoro, SAN, raised no objection to the withdrawal.

The charge was initially filed by the independent corrupt practices and other related offences commission, following a judgment of a london court in respect of a property belonging to former FCT minister, late general Jeremiah Useni.

At the resumed trial, the director of public prosecution of the federation, Rotimi Oyedepo, SAN, who represented the prosecution, told the court that after reviewing the case file he has the instructions of the AGF to withdraw the charge for further instruction.

Oyedepo said that the application was brought in line with section 108 of the administration of criminal justice act.

In response, Paul Erokoro, SAN, who led the defence team, confirmed that he had no objection to the prosecution’s withdrawal of the charge.
